Question:

Salaams Can I please confirm if it is correct when husband and wife have not had any intercourse for more that four months and they divorce. The marriage is automatically over and the girl does no longer need to do Iddah? regards, Ali Katouzian

Answer:

No it is it not right at all.
Husband must sleep with his wife at least once every four months, but if he
deliberately did not do that he will be committing a sin, that sin does not
mean that the marriage is void. Marriage remains valid until proper Talaq
is announced in front of two pious (Aadil) witnesses, with all the
conditions of Talaq. IDDAH is must after Talaq unless no sexual intercourse
took place since the beginning of the marriage.

Question:

Salaam un Alaikum My respected sayed i hope you are well, i have a  Serious issue and a ques for you i hope my brief explanation is enough for you to answer. I met a girl and we fell in love she is arab and i am not. Her family is against her marrying anyone who is not arab, we are both shia. We enetered into a secret muta marriage and then also a permanent marriage, we have had intercourse but now we are in doubt. The girl was NOT a virgin but she was unmarried. She is independant and of sane and mature mind, she works and does not get any financial support from her family in fact she provides money to her family. I have 2 questions for you. 1) As she was NOT a virgin is our marriage valid? 2) Her father said she can have a boyfriend is this permission? Islamically we cannot have relationships outside of marriage, so we have understood this to be a permission of muta. We follow taqleed of ayatollah sistani may allah swt prolong his life. I know it stated that repeated questions may not be answered but please syed we are in a serious dilema and a stressful situation and request an urgent reply. We do not know what to do can we continue with our marriage? Please email me seperately and not post the ques on the site. May allah swt bless you for your efforts. I am eagerly awaiting your reply. Thank you Ma salaama

Salam, what is the Shia view regarding female genital mutilation FGM??? specifically, is would it be obligatory for a wife to have FGM if her husband demands of her to do so?? Please give the opinions of Maraje in this regard, Jazak Allah

Answer:

FGM is not allowed as it endangers or harms the health of the female.
Husband has no right to ask his wife to do FGM and she has no obligation to
follow him in this matter.
